Terms of Service

1. Agreement to these terms

By creating an account or using Posteryzr (the “Service”), you agree to these Terms of Service and to our Privacy Policy. If you use the Service for a business, you confirm you’re authorized to accept these terms on its behalf. If you don’t agree, please don’t use the Service.

2. Eligibility and your account

You must be at least 18 years old to use the Service.

You’re responsible for the information in your account, for keeping your login secure, and for everything that happens under your account. Tell us right away at hello@posteryzr.com if you think someone has accessed it without permission.

3. What the Service does

Posteryzr uses artificial intelligence to create social media content for your business — captions, hashtags and images — based on information you provide, including your website. It also helps you plan and schedule that content. Features may change as we improve the Service.

4. Plans, billing and cancellation

Paid plans are billed monthly in advance through our payment provider, Stripe. Current plans are Starter ($29/month), Growth ($59/month) and Pro ($99/month); each includes a monthly number of posts and platforms.

• Subscriptions renew automatically each month until you cancel.
• You can cancel anytime from your account; your plan stays active until the end of the paid period.
• Unused posts don’t roll over to the next month.
• Except where required by law, payments are non-refundable.
• If a free trial is offered, it converts to a paid plan at the end of the trial unless you cancel first.
• We may change prices with at least 30 days’ notice; changes apply from your next billing period.

5. AI-generated content

AI can make mistakes. Generated content may be inaccurate, incomplete or unsuitable for your audience, and similar content may be generated for other users. You are responsible for reviewing content before it is published and for making sure it’s accurate — including prices, offers, dates and claims about your business.

Subject to these terms and your payment of applicable fees, you may use the content generated for your account for any lawful purpose, including commercial use.

6. Your content

You keep ownership of the content you provide, such as your logo, photos and business details. You grant us a limited license to host, process and display it only as needed to run and improve the Service for you. You confirm you have the rights to everything you upload.

7. Acceptable use

You agree not to use the Service to:

• Create content that is illegal, deceptive, defamatory, hateful, harassing or sexually explicit;
• Publish fake reviews or testimonials, or misleading claims about products or services;
• Infringe anyone’s intellectual property, privacy or other rights;
• Break the rules of the social media platforms you post to;
• Attempt to disrupt, overload, reverse engineer or gain unauthorized access to the Service;
• Use automated means to create accounts or extract data from the Service.

We may remove content or suspend accounts that break these rules.

8. Third-party platforms

When you connect Instagram, Facebook or another platform, your use of that platform is governed by its own terms. We aren’t responsible for third-party platforms, including changes to their features, rules or availability that affect publishing.

9. Our intellectual property

The Service, including its software, design and branding, belongs to Posteryzr and is protected by law. These terms don’t give you any rights to our trademarks or software beyond using the Service as intended.

10. Suspension and termination

You can stop using the Service and delete your account at any time. We may suspend or end your access if you break these terms or if required by law. Sections that by their nature should continue — such as ownership, disclaimers and limits of liability — survive termination.

11. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don’t guarantee any particular results, such as engagement, followers or sales.

12. Limitation of liability

To the fullest extent allowed by law, Posteryzr won’t be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim.

13. Indemnity

You agree to defend and indemnify Posteryzr against claims arising from content you publish, your use of the Service, or your breach of these terms.

14. Governing law

These terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules.

15. Changes to these terms

We may update these terms from time to time. If changes are significant, we’ll let you know by email or in the app before they take effect. Continuing to use the Service after that means you accept the updated terms.
